Brisbane Council Rules for Wall-and-Fence Combinations
When a retaining wall has a fence on top, Queensland councils assess each component separately. The retaining wall is assessed under the Building Act, while the fence is assessed under the Neighbourhood Disputes (Dividing Fences and Trees) Act 2011.
Retaining wall over 1 metre: Requires building approval and engineering certification. The engineer must design for the additional wind load from the fence.
Fence height: Measured from the natural ground level on the higher side of the wall. Most Brisbane council areas allow 2 metre fences without approval. However, the combined height from the lower side may trigger neighbour notification or additional approvals.
